OVERVIEW
The “rule of law” means that society is governed by fixed rules that are announced in advance and are predictably and consistently applied. It means that all individuals are equal before the law and that all government officials are subordinate to and subject to the law.
ARL regularly intervenes as a “friend of the court,” primarily before the Supreme Court of Canada. Through its interventions, ARL assists the court with various issues related to the rule of law, which helps ensure that the court maintains the rule of law at the forefront of its decision-making process.
ARL has intervened on a wide variety of issues. What separates ARL from other private interveners is that ARL does not seek to advance a particular policy position. All of its interventions are rooted in legal principle. As such, some of ARL’s positions imply a “liberal” result while others imply a “conservative” result. Others, still, imply a liberal result in a particular case, but a conservative result in a future case, or vice versa.
ARL is committed to educating the public about Canada’s constitutional order and legal system, and the way in which the rule of law operates on a day-to-day basis. It does so through the publication of scholarly articles, co-publishing the Dicey Law Review with the Runnymede Society, hosting continuing legal education events, and producing policy papers.
